1. About TravelQuest by Qlear

TravelQuest by Qlear ("TravelQuest", "we", "us", "our") is a group travel management platform that provides organisational tools for trip planning, financial record-keeping, shared expense tracking, and virtual wallet management. TravelQuest by Qlear is an independent software project operated by a single individual under the Qlear name. Qlear is not a registered company, business, or legal entity of any kind. TravelQuest by Qlear is not a bank, payment institution, electronic money institution, or financial services provider of any kind.

TravelQuest by Qlear does not hold, move, transmit, process, or safeguard any real funds on behalf of any user. All financial figures displayed within the platform are records entered by users for organisational purposes only. Any actual transfer of money between users takes place entirely outside of and independently from the TravelQuest by Qlear platform. We bear no responsibility whatsoever for the movement, custody, or loss of real funds between users.

2. Eligibility

By using TravelQuest by Qlear, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal capacity to enter into a binding agreement;
• You are not prohibited from using the platform under the laws of any applicable jurisdiction; and
• All information you provide is accurate, current, and complete.

We reserve the right to refuse access to the platform to any person at our sole discretion, without notice or explanation.

3. Account Registration and Security

Organisers must register an account using a valid email address. Buddies access the platform via a unique access code issued by a trip organiser and authenticate using their email address. You are responsible for:

• Providing accurate and truthful registration information;
• Keeping your account credentials secure;
• All activity that occurs under your account, whether authorised by you or not;
• Notifying us immediately if you become aware of any unauthorised access or use of your account.

Accounts are personal to the registered user and must not be shared, transferred, or sold to any third party. You may not register multiple accounts in order to circumvent any restriction or suspension.

4. Organiser Responsibilities

If you use TravelQuest by Qlear as a trip organiser, you acknowledge and agree that:

• You are solely responsible for the accuracy and integrity of all trip, expense, and financial records you create or manage on the platform;
• You are solely responsible for verifying any contribution or top-up submission made by a buddy before approving it. TravelQuest by Qlear provides no verification mechanism for off-platform payments;
• You will not use the platform to record false transactions, fabricate balances, or mislead any trip participant about the financial status of a trip;
• You are solely responsible for the fair and transparent management of all trip funds, including the proper allocation of expenses and distribution or return of any surplus funds to participants;
• You will ensure that any access code you share is distributed only to genuine trip participants; and
• Any dispute between you and your trip participants relating to finances is your sole responsibility to resolve. TravelQuest by Qlear will not mediate, arbitrate, or intervene in such disputes.

5. Buddy Responsibilities

If you use TravelQuest by Qlear as a trip buddy, you acknowledge and agree that:

• You will only submit top-up requests that accurately reflect payments you have actually made outside the platform;
• You will not submit false, duplicate, or inflated payment references;
• The trip organiser has sole and absolute discretion to approve or reject any top-up submission, and TravelQuest by Qlear plays no role in that decision;
• You will resolve any financial disputes or discrepancies directly with the trip organiser. TravelQuest by Qlear is not a party to any financial arrangement between you and your organiser; and
• Wallet balances shown on the platform are record-keeping figures only and do not represent funds held by TravelQuest by Qlear on your behalf.

6. Prohibited Uses

You agree not to use TravelQuest by Qlear, directly or indirectly, to:

• Engage in, facilitate, or conceal any fraudulent, deceptive, or unlawful activity;
• Conduct or record any money laundering, tax evasion, or other financial crime;
• Harass, intimidate, or harm any other user of the platform;
• Attempt to gain unauthorised access to any other user's account or data;
• Probe, scan, or test the vulnerability of the platform or circumvent any security or authentication measure;
• Reverse-engineer, decompile, or disassemble any part of the platform;
• Use automated tools, bots, or scripts to access or interact with the platform;
• Transmit malware, viruses, or any other harmful or disruptive code; or
• Violate any applicable local, national, or international law or regulation.

We reserve the right to immediately suspend or terminate any account that we reasonably believe is engaged in prohibited conduct, without prior notice and without liability to you.

7. Intellectual Property

All content, design, software, trademarks, and materials comprising the TravelQuest by Qlear platform are owned by or licensed to us and are protected by applicable intellectual property laws. Nothing in these terms grants you any right, title, or interest in our intellectual property.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the platform without our prior written consent.

By submitting any content to the platform (including trip names, descriptions, and notes), you grant us a non-exclusive, royalty-free licence to store and display that content solely for the purpose of operating the service. You retain ownership of your own content.

8. Disclaimer of Warranties

TravelQuest by Qlear is provided "as is" and "as available", without any warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the platform will be uninterrupted, error-free, or free of viruses or harmful components;
• Any warranty as to the accuracy, completeness, or reliability of any financial records entered by users; and
• Any warranty that the platform will meet your requirements or expectations.

You use the platform entirely at your own risk. TravelQuest by Qlear is a record-keeping tool — we make no representations about the accuracy of user-submitted data and take no responsibility for any financial decisions made in reliance on information displayed on the platform.

9. Limitation of Liability

To the fullest extent permitted by applicable law, TravelQuest by Qlear and its operators, directors, employees, agents, and licensors shall not be liable for any:

• Loss of funds, money, or financial assets of any kind;
• Indirect, incidental, special, consequential, punitive, or exemplary damages;
• Loss of profits, revenue, data, goodwill, or business opportunity;
• Damages arising from your reliance on information displayed on the platform;
• Damages arising from disputes between organisers and buddies; or
• Damages arising from the acts or omissions of any third party.

In any event, our total cumulative liability for any claim arising from or related to these terms or your use of the platform shall not exceed £50 (fifty pounds sterling), regardless of the form of action or the basis of the claim.

Some jurisdictions do not permit the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless TravelQuest by Qlear and its operators, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the platform;
• Your breach of these Terms of Service;
• Any financial dispute between you and another user;
• Any false or misleading information you submit; or
• Your violation of any applicable law or the rights of any third party.

11. Third-Party Services

TravelQuest by Qlear integrates with third-party services including Google Firebase (for data storage) and Resend (for email delivery). Your use of the platform is also subject to the applicable terms and policies of these providers. We are not responsible for the availability, accuracy, or conduct of any third-party service.

12. Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your access to TravelQuest by Qlear at any time, with or without cause and with or without notice, for any reason including your breach of these terms or any conduct we deem harmful to other users or to the platform.

You may close your account at any time by contacting us. Upon termination, your right to access the platform ceases immediately. Provisions of these terms which by their nature should survive termination — including limitations of liability, indemnification, and governing law — shall survive.

13. Changes to These Terms

We may revise these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of TravelQuest by Qlear after any changes take effect constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the platform.

14. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of or in connection with these terms or their subject matter or formation (including non-contractual disputes or claims).

15. Severability and Entire Agreement

If any provision of these terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions. These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and TravelQuest by Qlear regarding your use of the platform and supersede all prior agreements, representations, or understandings.
